How Much Does a Divorce Cost in Czechia?
From a 2 000 Kč court fee to six-figure fights: what uncontested and contested divorces really cost, and where the money actually goes.
The honest answer has a huge range: an agreed divorce with no property to divide can cost little more than the 2 000 Kč court fee, while a contested divorce with a business, a mortgage and a custody fight can consume hundreds of thousands of crowns. The difference is almost never the lawyers'' rates. It is the level of conflict.
The fixed baseline: court fees
The court fee for a divorce petition is 2 000 Kč (item 4 of the schedule to Act No. 549/1991 Sb.). Proceedings about the care of minor children are free of court fees. Settling property (vypořádání SJM) by court adds its own fee — filing a property-settlement claim costs 2 000 Kč plus percentage components where real estate and larger sums are involved; settling by agreement avoids that entirely. A notarial deed for a property-regime agreement, where wanted, is priced by the notarial tariff from the value concerned.
The uncontested divorce: a package price
Where spouses agree — on the children through the guardianship court, on property, on housing — most family lawyers offer the whole package for a fixed fee. Market practice for a straightforward agreed divorce runs roughly 15 000 to 40 000 Kč including drafting the parenting plan, the property settlement, both petitions and representation at the short hearings. Prague sits at the upper half of that range. Given that the settlement agreement permanently disposes of flats, mortgages and pensions, this is the best-value legal product most people ever buy.
The contested divorce: paying by the round
Once spouses fight, costs scale with rounds of submissions and hearings, billed hourly — typically 2 000 to 4 500 Kč per hour depending on city and seniority. A custody dispute with an expert opinion (psychological assessments of both parents and the child add roughly 20 000–50 000 Kč, sometimes more), two or three hearings and the usual procedural skirmishes easily consumes 80 000 to 250 000 Kč per side, and property fights over businesses or real estate go beyond that, driven by valuation experts as much as by lawyers.
Two structural facts make contested divorces expensive. First, three proceedings run, not one: children (guardianship court), the divorce itself, and property settlement. Second, in family matters each side generally bears its own costs — winning does not hand the bill to the other spouse the way it can in commercial disputes.
What actually moves the total
The levers are unromantic. Agreeing on the children removes the most expensive and most painful front — custody experts and repeated hearings. Valuing property realistically early prevents the classic pattern where both sides pay experts to argue about a flat whose price Zillow-style portals estimate within ten percent anyway. Choosing mediation for sticking points costs hundreds per hour instead of thousands per submission; courts can order a first mediation session in any case. And separating emotion from negotiation — the sentence every divorce lawyer repeats — because litigating a point of principle for 60 000 Kč to gain 40 000 Kč happens weekly in Czech courtrooms.
A realistic budget conversation
For an agreed divorce with a flat and a mortgage: expect the package fee, the 2 000 Kč court fee, certified signatures, and possibly a notarial or escrow cost for refinancing the mortgage into one name — under 50 000 Kč all-in for most couples.
